General terms and conditions of business
General information
The general terms and conditions are the basis for a fair customer relationship. By sending an order the customer agrees to the general terms and conditions. We do our utmost to satisfy our customers’ needs and to their complete satisfaction.
Area of application
Our entire offer of www.direkta.online is aimed at a clientele within Switzerland and the Principality of Liechtenstein. Deliveries abroad require prior consultation.
Prices
The prices of the products are quoted net in Swiss Francs (CHF) including value added tax and statutory fees. Bodyforming&Cosmetics GmbH reserves the right to change the prices of the offered products at any time. The prices stated in our order confirmation are decisive.
Payments
Our prices are quoted strictly net, payable within 30 days; cash discounts are not recognised. The goods remain the property of Bodyforming&Cosmetics GmbH until the invoice has been paid in full. For late payments a default interest can be charged. Bodyforming&Cosmetics GmbH reserves the right to charge reminder fees, if applicable. All credit card payments are processed by means of the secure e-payment solution for online payments.
Order processing
After electronic order receipt, the order is checked. Any changes will be communicated by telephone or electronically within five working days.
Delivery and packaging costs
The delivery is made to the invoice recipient or to a delivery address chosen by him. In principle, the ordered goods will be delivered on our behalf by mail according to the following cost regulations:
Orders up to CHF 299 Shipping costs CHF 10.00
Orders over CHF 300 free of shipping costs
Any express costs shall in any case be borne by the customer.
Delivery
The delivery dates stated by Bodyforming&Cosmetics GmbH are to be considered as guidelines only, unless otherwise expressly assured in writing. The indication of a delivery date is made to the best of our knowledge, but without guarantee. This shall apply in particular in the event of delays in delivery, e.g. due to replenishment problems at the manufacturer/supplier. Partial deliveries are permissible. Unavoidable events such as force majeure, strikes etc. entitle Bodyforming&Cosmetics GmbH to postpone delivery or, if necessary, to withdraw from the contract.
General availability
A complete and constant availability of our offer on www.direkta.onlinecan be guaranteed, but at extended delivery times.
Complaints
The quality of the received goods must be checked immediately after receipt; after 5 days the delivery is considered approved.
No compensation will be paid for damage due to improper storage.
In case of warranty Bodyforming&Cosmetics GmbH shall be entitled at their discretion: – to deliver a replacement against return of the rejected goods, – to refund the purchase price – or to compensate the reduced value of the goods while maintaining the sales contract. If notification is not made in time, all guarantees and other claims of the customer expire, unless the damage or defect was not recognisable during the required incoming goods inspection.
Return of goods
A return of products by the customer is possible within 8 days from the date of delivery, requires the prior consent of Bodyforming&Cosmetics GmbH and is at the expense and risk of the customer. The return of the products has to be made in original packaging and has to be accompanied by a detailed description of the error/defect.
Data protection
Personal customer data is treated confidentially in accordance with data protection legislation and is neither passed on nor sold to third parties. Sensitive data, especially credit card payments, will be transmitted in encrypted form for the authorization request. Only data that is necessary for processing the order and that simplifies the operation of the online shop for returning customers will be collected.
The privacy policy, which is published on the Direkta online shop of Bodyforming&Cosmetics GmbH, is part of these terms and conditions. By accepting these GTC, the customer also declares to agree to the privacy policy.
Liability
Bodyforming&Cosmetics GmbH assumes no liability for undeliverability or late delivery of products due to wrongly declared delivery addresses, absence of the recipient, customs problems (export) or events which are due to force majeure.
Bodyforming&Cosmetics GmbH assumes no liability for damages or viruses that have been caused by accessing its website.
Bodyforming&Cosmetics GmbH shall also not be liable for claims for compensation for damages which have not occurred to the product itself, such as loss of production, loss of orders, loss of profit as well as other indirect or consequential damages.
